The House Energy and Commerce Committee is investigating whether or not the EPA can legally limit carbon emissions at new power plants. Via Fox News, the committee is examining the EPA’s authority to draft its regulations based on the deployment of a handful of carbon capture and storage technology at government-funded projects. Members of the committee have asked EPA Administrator Gina McCarthy to turn over documents and information in an effort to examine the legality of the agency’s rulemaking. The EPA formally proposed its rules for carbon emissions at new power plants in January.
The House last Thursday passed a bill that would prevent the agency from mandating technology unless it has proved commercially viable for at least one year.
